What is a Statutory Demand?
A Statutory Demand is a formal notice to request payment of a debt within 21 days.
A Statutory Demand may be served on an individual or a company.
What happens if a Stautory Demand is ignored?
If the amount owing is over £750 Bankruptcy proceedings may be commenced against an individual. If a company owes over £750 then an Winding-Up Petition may be served on the company.
If the demand was served personally then the process server or person who served the demand will need to complete a certificate of personal service.
How do you serve a Statutory Demand?
You can deliver it in person to an individual, company director or employee. Usually a solicitor arranges a Process Server to hand deliver the Statutory Demand.
The demand may also be served by registered post or hand delivered through a letterbox (substituted service).
How do you appeal or challenge a Statutory Demand?
If you do not agree with the demand then you must reply to the court within 18 days with an application to set aside the statutory demand.
Do not ignore a Statutory Demand. Speak to a solicitor for legal advice as soon as possible.
The solicitor may be able to make an application to the court to have the Demand set aside.
